General terms and conditions of business

1. Subject of the contract

Santa Monica Sport AG (SM) sells the goods to the customer under the following general terms and conditions (GTC).

2. Conclusion of contract

The purchase contract is concluded when we confirm acceptance of the order in writing within 48 hours (system invoice does not count as delivery confirmation) or we carry out a delivery. If, again, the ordered items are no longer in stock or can no longer be delivered, SM is not obliged to carry out the order. The offer relates to the goods as shown or described on our website. The goods are subject to minor deviations from the representation on the website in terms of colour, design and execution. If SM subsequently recognizes that an error has crept in, for example information about a product, a price or availability, SM is entitled not to enter into the contract

3. Product Offering

All information about the goods that the customer receives as part of the ordering process is non-binding. In particular, we reserve the right to make changes in design and technology that improve the functionality of a product, as well as errors in description, illustration and price information.

4. Prices/Terms of Delivery

The respective listed prices apply, which can be continuously adjusted to the market. They are understood to be in Swiss francs (CH) or euros (EU) postage paid ex warehouse in Zurich (CH) or warehouse in Germany (EU). The transport will be charged separately. Payment must always be made net prior to delivery.

5. Conditions of Transport

If in stock, the products will be delivered immediately to the address specified by the customer. The goods are delivered at the expense and risk of the retailer. In the event of externally visible damage to the goods ordered, any damage settlement will only be made against a certificate from the respective carrier. Any delivery discrepancies must be reported in writing within 8 days of the date of receipt. Any claim expires after this period.

6. Return Policy

The customer has the right within a period of 8 calendar days to revoke the conclusion of the contract without giving reasons and to return the goods. The delivered goods are undamaged, unused and must be returned in full at the customer's expense. The right of return begins with the receipt of the goods by the customer. Excluded from the right of return are articles that have been specially made on customer request. If the customer has returned the goods on time and properly, he will receive a credit note from SM or, if desired, a replacement delivery or refund.

8. Warranty for Defects/Liability

The respective guarantee provisions of the individual countries apply to the customer. (CH 1 year. Products will be replaced or repaired free of charge. Parts that are the result of normal wear and tear, accidents or improper use (assembly errors) are excluded from the warranty. The return shipment is at the expense of the dealer. SM is not liable for consequential damage.

11. Jurisdiction and Applicable Law

These General Terms and Conditions and the contracts concluded on the basis of these General Terms and Conditions are subject to Swiss law. Place of jurisdiction is Zurich.

12. Final Provisions

When selling the products specified by SM, the General Terms and Conditions apply exclusively in the version valid at the time the respective contract was concluded. These apply in any case, even if they differ from the dealer's customer regulations. Should individual provisions of these General Terms and Conditions be or become ineffective, this shall not affect the legal validity of the remaining provisions. Furthermore, SM reserves the right to amend these General Terms and Conditions at any time.
